Minister in trouble for his alleged old link with ULFA
The Krishak Mukti Sangram Samiti (KMSS) recently announced that it would move to the Supreme Court seeking its intervention in re-opening of TADA cases against the health minister and spokesman of the Assam government Dr Himanta Biswa Sharma.
KMSS general secretary Akhil Gogoi said at a press conference that their organisation was able to get the original case diaries of the case no 15/1991 of Panbazar police station and case no 77/1991 of Chandmari police station.
Earlier, an MP from Jharkhand Sukhdeo Paswan had also filed a PIL in Gauhati High Court demanding a probe into Sharma's alleged links with the terrorist outfit ULFA at the time when he was a student leader. Also, Paswan had accused Sharma of playing an important role in an extortion case of about Rs 90 lakh. It is alleged that the minister had acted on behalf of ULFA. Later Paswan withdrew the PIL for reasons best known to him only. But he was fined Rs 1 lakh for wasting court's time. He was not alone in doing so. MLA Padma Hazarika of the opposition party had also filed a PIL against Sharma, but withdrew it at the last moment.
A senior advocate of the Gauhati High Court, Nekibur Zaman, told TSI that he was the first person to take up these two cases to the court in 2005. 'I had with me sufficient documents at that time. I wanted to fight the case. I had with me technical evidences also. I met the leaders of the opposition AGP at that time. They accepted all the documents from me, but later did not raise the issue. There might be some understanding between them. We must say that the laws are strict, but at the same time there are many loopholes. So, he got more than five years time and he was able to manage these cases.''
Moreover, Zaman also said that in the Panbazar police station case the name of Sharma was not in the accused list. And in the Chandmari case though he was accused the police report clarified it that they were unable to get sufficient evidence regarding the involvement of Sharma.
Though the KMSS leader claims that the lost case diaries were with them, but according to the health minister the case diaries were never lost. If that is so then why has Akhil been claiming that they were able to lay their hands over the lost case diaries?
Defending his move, Akhil said: 'We will take up the matter to the Supreme Court and we have already discussed it with some prominent retired judges. We have sufficient documents with us to convince a judge. The process is going on. So, we can expect the best result.''
Can Sharma manage to blunt another attack on him this time?
